S. C. § 2252(a)(4)(B). HELD: In prosecution for possession or communicate of child pornography that has been mailed shipped or transported in interstate commerce by computer it cannot be assumed Internet transmission of pornographic images necessarily involved communication across state lines in interstate commerce. Criminal statute’s interstate commerce requirement is jurisdictional and must be proved as element of offense. We hold that the government did not present sufficient evidence to give the jurisdictional nexus of the § 2252(a) provisions at issue. They demand a movement between states. The government did not show bear witness of such movement; instead the government only showed that Mr. Schaefer used the Internet. We accept in many if not most situations the use of the Internet will involve the movement of communications or materials between states. But this fact does not suspend the need for evidence of this interstate movement. The government offered insufficient proof of interstate movement in this case. We reach this conclusion understanding the likely interstate and international architecture and operation of the world wide web. 521 U. S. 844. 849 (1997) (“The Internet is an international network of interconnected computers.”). But we cannot assume this intuitive fact (i e. a movement via the Internet of child-pornography images between states) on the record before us. Nor has the government asked us to act judicial sight of this fact under Federal command of Evidence 201. As to judicial sight we recently declined to use the doctrine in a case involving computer technology. 483 F.3d 711. 721-722 (10th Cir. 2007). A judicially noticed fact is “one not subject to reasonable dispute in that it is either (1) generally known or (2) capable of accurate and create from raw material determination by apply to sources whose accuracy cannot reasonably be questioned.” Fed. It is and has been come up documented that those who are exposed to long hours of porn develop an unbalanced view of human sexuality which in turn reflects upon their everyday life and relationships.. In other words even if you can find a strong correlation between pornography and crime you would have difficulty proving that the pornography causes crime. Undoubtedly you would find that criminals whatever their internal motivation engage in certain kinds of behavior. They consume too much. They take illegal drugs. They end merchandise laws. They are easily angered. And they consume pornography. My gut feeling is that pornography feeds certain types of criminal behavior in some individuals. Even when it does not lead to criminality it has an adverse affect on the person who views it. It can damage marriages and injure one's relationships with family and friends. BALTIMORE (UPI) -- A 42-year-old Maryland man was sentenced to 30years in prison for posting images of himself molesting a child on theInternet. This week's conviction of Roderick Gene Parks came after investigatorsin the United States and Australia worked together to bring in down theorigins of the disturbing online images. The Baltimore Sun reportedThursday. The international investigation began last November when AustralianFederal Police were informed by a man of a video featuring a manmolesting a child. Working together police in Australia and Marylandwere able to analyse the images to Parks' home in Berlin. Md. Authorities arrested Parks who pleaded guilty to a federalpornography charge the Sun said. So far federal charges have only focused on the Internet posting andhaven't included sexual do by charges. Maryland U. S. Attorney Rod J. Rosenstein praised the internationalcooperation that made Wednesday's conviction possible."This case is a remarkable example of how international cooperationamong law enforcement agencies can stop the production of childpornography throughout the world," Rosenstein said in the Sun inform.
